This Indenture made this eighteenth day of July in the year eighteen Hundred
and eight Between Henry Massie of the County of Ross and State of Ohio of the
one part and Jonas Rowtroff and Henry Nace of the said County and State of the
other part. Witnesseth that the said Henry Massie for and in consideration of
the sum of One thousand and fifteen dollars current money of the United States
of America to him in hand paid by the said Jonas Rowtroff and Henry Nace at or
before the sealing and delivery of these presents the Receipt whereof the said
Henry Massie doeth hereby acknowledge and thereof doeth release acquit and
discharge there the said Jonas and Henry their heirs executors administrators
and assigns and every of them ------- he the said Henry Massie for himself and
his heirs hath given granted bargained sold ------- released conferred and
confirmed and by these presents for himself heirs doth give & grant bargain
sell ---- released use off and confirmed unto the said Jonas Rowtroff and
Henry Nace their heirs and assigns forever the following tract or parcels of
land lying and being within the county of Highland and the state aforesaid on
the waters of Brush Creek part of a survey in the name of Thomas Christie
number seven hundred and thirty three and bounded as follows to wit.
Beginning a white oak hickory and dogwood the southeast corner to said
Christie survey and running thence North eighty one degrees west two hundred
and six poles to Sugartree and hickory tree north nine degrees east two
hundred and four poles to a stake thence North three degrees east ninety poles
to a white oak and sugartree thence south eighty one degrees east two hundred
and two poles to a white oak sugartree and hickory thence south five degrees
and thirty minutes west three hundred poles to the beginning Containing three
hundred and seventy-three acres more or less. To have and to hold the said
tract or parcel of land that is to say one undivided moiety of said tract to
Jonas Rowtroff his heirs and assigns forever and the other remaining moiety
unto the said Henry Nace his heirs and assigns forever as tenants in common
and not as joint tenants to them and each of their heirs only proper use and
behoof in the proportions as aforesaid to them and each of their heirs and
assigns forever and the said Henry Massie for himself and his heirs doeth
hereby covenant and agree to wit with the said Jonas Rowtroff and Henry Nace
and them and each of their heirs and assigns to warrant and forever defend the
premises aforesaid according to the proportions aforesaid against all and
every person or persons whatsoever claiming the same. In witness whereof the
said Henry Massie hath hereunto set his hand and seal the day and year just
above written.
