WILL OF JOHN HILL - 1853

PROBATE COURT, HIGHLAND COUNTY, OHIO NO. 1664


In the name of the Benevolent Father of all, I John Hill of Highland County Ohio being of Sound mind & memory but being in Ill Health & Confined to my Bed Do make & Publish this to be my Last Will and Testement.

Item 1st That all my Debts & Funeral Expences be paid out of the proceeds of Some of my Property as here after Directed,

Item 2nd That my Wife Rebecca has her right in my Land & Property that the Law allows,

Item 3rd I Will to my Daughter Mary all my Farm which I now live on Situated in The County & State afforesaid in Marshall township with all my horses Cattle & all other property that I have, with all the money & Credits that is coming to me, But my Daughter Mary is to pay all my Debts & Funeral Expences

4th And Last Item I do hereby nominate and appoint John L. Hughes Executor of this my Last Will & Testement hereby authorising & Empowering him to compromise and ajust release and Discharge in such manor as he may think proper the Debts & Claims Due me I so also authorize & Empower him if it shall become necessary in order to pay my Debts to sell by private or in Such manner, upon such Terms of Credit or otherwise as he may think proper all or any part of my Real Estate & ____ (seed?) to purchaser or purchasers to Execute Acknowledge & Deliver in fee Simple so the Expenses & Attorney fees & Court Charges then if any is Left to be paid over to my Daughter Mary

I do hereby Declare this to be my Last Will & Testement and Leave it in the hands & care of my Executor John L. Hughes | given under my hand and Seal this 27th day of May A.D. 1850

The undersigned being duly sworn in open Court this 11th day of April A.D. 1853 deposes and says that he was present at the Execution of the last will and testament of John Hill hereunto annexed, that he saw the said testator subscribe the said will, and heard him publish and declare the same to be his last will & testament, and that the said testator at the time of Executing the same was of full age and of sound mind & memory and not under any restraint, and that he signed the same as witness thereto, at his request and in his presence. -

The undersigned being duly sworn in open Court this 11th day of April A.D. 1853 deposes and says that he was present at the Execution of the last will and testament of John Hill hereunto annexed, that he saw the said testator subscribe the said will and heard him publish and declare the same to be his last will and testament, and that the said testator at the time of Executing the same was of full age, that he hesitates to say whether he was of sound mind & memory or not, that he will not say that he was not of sound mind and memory, that the said testator knew what property belonged to him at that time, and gave directions how it should be disposed of in said will and was aware what disposition he was making of it by said will, that he, the said testator, knew all the persons who were present at the time, that his mind that he cannot say whether said testator's mind has undergone any change for a year next previous to making said will as he knows of none, that after said will was written it was read to him the said testator, and the said testator then said he was satisfied with it, that said testator at the time of making said will was under no restraint, and that this deponent signed the same as duly emli___ (enlisted?) witness at the request and in the presence of said testator as also in the presence of Bruden Smith, the other subscribing witness.
