ORDER

Now on this 24^th day of December, 1930, the above entitled cause comes on upon the motion of said defendant to suppress the evidence introduced herein for the reason that the same was obtained by a search of the residence of said defendant without a search warrant.

The State is present by Harry F. Blake, County Attorney, and the defendant is present in person and by his Attorney, A. V. Dinwiddie, and the Court after hearing said motion should be, and the same is hereby, sustained and said cause dismissed as to the said Timothy Ansley, and the Sheriff of Logan County, Oklahoma, is hereby directed to release said defendant from further custody.
