This Indenture Witnesseth, that J.W. Minnick for the consideration of the sum of Four Hundred and Fifty Dollars, to him paid, has bargained and sold, and by these presents do he bargain, sell and convey unto R.V. Davis, D. J. Davis and J.M. Davis the following described premises, to-wit:

The undivided and fourth interest in and to the following described lands—North West Quarter of the South East Quarter and the South West Quarter of the North East Quarter and the South East Quarter of the North West Quarter and the East Half of the South West Quarter of Section 12 all in Township 4 South of Range 40 East, W.M., and in Union County, Oregon.

To Have and to Hold the said premises, with their appurtenances, unto the said R.V., D.J. and J.M. Davis, theirs and assigns forever.  And the said John W. Minnick do he hereby covenant to and with the said R.V., D.J. and J.M.  Davis, and theirs and assigns, that he is the owner in fee simple of said premises, that they are free from all encumbrances, and that he will warrant and defend the same from all lawful claims whatsoever.

Davis, a single man, of Madison County, State of Montana, for the consideration of the sum of One Hundred Dollars, to him paid, has bargained and sold, and by these presents do quitclaim and convey unto R.V. Davis of Union County, Oregon the following described premises, to-wit:

This Indenture Witnesseth, That D. J. Davis, of Madison County, Montana and Minnie Davis, his wife, for consideration of the sum of Six Hundred (600) Dollars, to us paid have bargained and sold, and by these presents do bargain, sell and convey unto R. V. Davis the following described premises, to wit:

The Southwest Quarter of the Northeast Quarter; the Southeast Quarter of the Northwest Quarter; the East Half of the Southwest Quarter and the Northwest Quarter of the Southeast Quarter, all in Section Twelve, Township Four South Range Forty East Willamette Meridian and in Union County, Oregon, to the extent of an undivided one-third interest of in and to the said property.

To Have and to Hold the said premises, with their appurtenances, unto the said R. V. Davis his heirs and assigns forever.  And the said D. J. Davis and Minnie Davis, his said wife, do hereby covenant to and with the said R. V. Davis, his heirs and assigns, that they the owners in fee simple of said premises; that they are free from all incumbrances, and that they will warrant and defend the same from lawful claims whatsoever.

Co. of Brooklyn, N.Y. for three years, on property described in said application; also a cash payment of $—, and note for $10.00 due November 1, 1884 in settlement of premium on said insurance.  Policy for same to be forwarded by mail from General Office at San Francisco.  G.W. Howard, Agent.

Amount insured: $500.
Charged for policy:  $10.
Policy coverage from March 31, 1884 at 12 o’clock at noon to March 31, 1887.

In consideration of no dollars cash and the payment at maturity of ten dollars for which the insured hereafter named has executed a certain promisory note or obligation of even date herewith and payable on the first day of November 1884.  Do insure Josiah Davis against loss or damage by fire to the amount of five hundred and 00/100 dollars as follows:

$350.00 on 1 story shingle roof frame building occupied by insured as a dwelling
$100.00 on household furniture and provisions, while in dwelling
$50.00 on wearing apparel, while in dwelling

Agreement between J. W. Minnick and R. V; D. J. & J. M. Davis.

This agreement witnesseth that whereas, Mary Minnick, now deceased, lately the wife of J. W. Minnick, and R. V. Davis, D. J. Davis and J. M. Davis, are the children and heirs at law of Josiah Davis and Sarah Davis both deceased, And whereas the said Josiah Davis leaving real estate and personal property and the said Sarah Davis died leaving personal property in Union County Oregon, And the said Mary Minnick died leaving five children and her said husband surviving her, said children being Jesse May Minnick, Macy Ellen Minnick, Mary Cromwell Minnick, William Austin Minnick and Ivy Vernon Minnick.  and all minors, And in which real estate and personal estate, the said J. W. Minnick has an interest as the surviving husband of the said Mary Minnick deceased, And for the purpose of adjusting the property rights of the said various parties, without incurring the expense and delay of Court proceedings,

Now therefore, in consideration of all the above described premises, and the sum of $450.00 this day paid by the said R. V., D. J. & J. M. Davis, to the said J. W. Minnick, for his own benefit and the benefit of his said children, according to their respective interests in the said property, The said J. W. Minnick hereby bargains, sells and conveys to the said R. V. Davis, D. J. Davis & J. M. Davis all his right title and interest in or to the any and all of the property of which the said Josiah Davis and Sarah Davis died seized or possessed, both real and personal said real estate being described as follows, viz;

the N.W. qr. of S.E. qr.; S.W. of N.E.; S.E. of N.W.; and E. half of S.W. qr. Sec. 12, T.4 S. of R.40 E. W.M. and for which a contract has this day been made by the said J.W. Minnick to the said R. V., D. J. & J. M. Davis, not only for himself, but also warranting the title there to against the claims of the said children.

And this contract shall stand as the bill of sale of the said personal property, of what ever nature.  And for the same considerations, and as part of this contract, the said J. W. Minnick hereby covenants and agrees with the said R. V., D. J. & J. M. Davis their heirs and assigns that he will cause to be executed to the said R. V., D. J. & J. M. Davis, or their heirs or assigns, by each of the said minor children or the said Mary Minnick deceased, viz Jesse May; Macy Ellen; William Austin; Mary Cromwell; and Ivy Vernon Minnick, as soon as each arrives at his majority, a good and sufficient deed of conveyance to their respective interests in the said real estate, the same to be procured at the expense of the said J. W. Minnick.

And in default thereof, or of the fulfillment of the terms of this agreement by the said J. W. Minnick; the said R. V.; D. J.; & J. M. Davis or their heirs or assigns may perfect the title to said lands as to the interest of the said minors above named, in the cheapest way possible at the expense of the said J. W. Minnick not exceeding the sum of $500.00.  And the said J. W. Minnick hereby undertakes to save the said R. V.; D. J.; & J. M. Davis and their heirs and assigns harmless therefrom.

Quit Claim Deed

This indenture witnesseth that Jessie May Minnick (unmarried) for and in the consideration of the sum of One Dollar in hand to her paid by R.V. Davis, D.J. Davis, and J.M. Davis, the receipt whereof is hereby acknowledged, has sold, bargained, released, and quit claimed unto the said R.V. Davis, D.J. Davis, and J.M. Davis the following described real estate to-wit:

The N.W. qr. of S.E. qr.; S.W. qr. of N.E. qr.; S.E. qr. of  N.W. qr.; and E. half of S.W. qr. of sec. 12, Tp. 4 S. R. 40 E.W.M. in Union County, Oregon.

To have and to hold the above granted premises unto the said R.V. Davis, D.J. Davis, and J.M. Davis, their heirs and assigns forever.

Know All Men by These Presents, That W A Minnick, unmarried, of High Valley, County of Union, State of Oregon, in consideration of one dollars to me paid by R. V. Davis and D. J. Davis of High Valley, County of Union, State of Oregon, has bargained and sold, and by these presents does grant, bargain, sell and convey unto said R. V. Davis and D. J. Davis, their heirs and assigns, all of the following bounded and described real property, situated in the County of Union and State of Oregon:

The NW4 of SE4; The SW4 of NE4; SE4 of NW4; and E2 of SW4 of Sec 12, Tp 4 S R40 E W M.

Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, and also all his estate, right, title and interest in and to the same, including dower and claim of dower.

To Have and to Hold the above described and granted premises unto the said R. V. Davis and D. J. Davis, heirs and assigns forever.  This deed is made executed and delivered for the purpose of conveying the interest of the grantor in the estate of Josiah and Sarah Davis now deceased, as heir at law of said decedants.

Know All Men by These Presents:  That Ivy Vernon Minnick (unmarried) one of the heirs at law of Mary Minnick deceased and over the age of eighteen years, of Union, Union County, State of Oregon, in consideration of One 00/100 Dollars to her paid by R. V. Davis of Union, Union County, State of Oregon, has bargained and sold, and by these presents does grant, bargain, sell and convey unto said R. V. Davis heirs and assigns, all of the following bounded and described real property, situated in the County of Union and State of Oregon:

The North West quarter of the South East quarter; the South West quarter of the North East quarter; the South East quarter of the North West quarter and the East half of the South West quarter of Section Twelve (12) in Township Four (4) South of Range Forty (40) East of the Willamette Meridian

together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, and also all her estate, right, title and interest in and to the same, including dower and claim of dower.

To Have and to Hold the above described and granted premises unto the said R. V. Davis heirs and assigns forever.  And Ivy Vernon Minnick grantor above named does covenant to and with R. V. Davis the above-named grantee his heirs and assigns that she is lawfully seized in fee simple of the above granted premises, that the above granted premises are free from all incumbrances, and that she will and her heirs, executors and administrators, shall warrant and forever defend the above granted premises, and every part and parcel thereof, against the lawful claims and demands of all persons whomsoever.

I certify that the within instrument was received for record on the 5 day of July, 1910, at 9:25 o’clock a.m. and recorded in 52 on page 248 Record of Deeds of said county.

Know All Men by These Presents:  That Abel E. Eaton and Rose M. Eaton, his wife, of Union, Union County, State of Oregon, in consideration of one dollar and other valuable considerations, to them paid by R. V. Davis of Union, Union County, State of Oregon, has bargained and sold, and by these presents does grant, bargain, sell and convey unto said R. V. Davis, his heirs and assigns, all of the following bounded and described real property, situated in the County of Union and State of Oregon to-wit:

Beginning at the northwest corner of the South East quarter of the North East quarter of Section Twelve (12), running thence East twenty (20) rods, more or less, to a certain rock, (there placed by said R. V. Davis and Abel E. Eaton) thence South to the center of the public road, thence in a southwesterly direction, along the center of said road, to a point where the same intersects the west line of the South East quarter of the North East quarter and North East quarter of the South East quarter of said Section 12, thence north to the place of beginning; all in said Section 12, in Township Four (4) South of Range Forty (40), East of the Willamette Meridian, containing 5 acres more or less; together with the right to convey water from Little Creek to the said land, as the same is now being conveyed and used for watering stock;

together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, and also all their estate, right, title and interest in and to the same, including dower and claim of dower.

To Have and to Hold the above described and granted premises unto the said R. V. Davis his heirs and assigns forever.  And Abel E. Eaton and Rose M. Eaton, grantors above named do covenant to and with R. V. Davis the above-named grantee his heirs and assigns that they are lawfully seized in fee simple of the above granted premises, that the above granted premises are free from all incumbrances, and that they will and their heirs, executors and administrators, shall warrant and forever defend the above granted premises, and every part and parcel thereof, against the lawful claims and demands of all persons whomsoever.

To all whom these presents shall come, Greeting:
La Grande 02059.

Whereas, Robert V. Davis has deposited in the General Land Office of the United States a Certificate of the Register of the Land Office at La Grande, Oregon, whereby it appears that full payment has been made by the said Robert V. Davis according to the provisions of the Act of Congress of the 24th of April, 1820, entitled “An Act making further provision for the sale of the Public Lands,” and the acts supplemental thereto, for the southwest quarter of the southeast quarter of Section twelve in Township four south of Range forty east of the Willamette Meridian, Oregon, containing forty acres,  according to the Official Play of the Survey of the said lands, returned to the General Land Office by the Surveyor General, which said Tract has been purchased by the said Robert V. Davis.

Now know ye, that the United States of America, in consideration of the premises, and in conformity with the several Acts of Congress in such case made and provided, have given and granted, and by these presents do give and grant, unto the said Robert V. Davis and to his heirs, the said Tract above described; to have and to hold the same, together with all the rights, priveleges, immunities, and appurtenances, of whatsoever nature, thereunto belonging, unto the said Robert V. Davis and to his heirs and assigns forever; subject to any vested and accrued water rights for mining, agricultural, manufacturing, or other purposes, and rights to ditches and reservoirs used in connection with such water rights, as may be recognized and acknowledged by the local customs, laws, and decisions of courts, and also subject to the right of the proprietor of a vein or lode to extract and remove his ore therefrom, should the same be found to penetrate or interesect the premises hereby granted, as provided by law; and there is reserved from the lands hereby granted, a right of way thereon for ditches or canals constructed by the authority of the United States.

In testimony wherof, I, William H. Taft, President of the United States of America, have caused these letters to be made Patent, and the seal of the General Land Office to be hereunto affixed.  Given under my hand, at the City of Washington, the third day of March, in the year of our Lord one thousand nine hundred and ten and of the Independence of the United States the one hundred and thirty-fourth.
