SAMUEL MONTEITH APPLIES FOR REVOLUTIONARY PENSION


Declaration in order to obtain the benefits of
and Act of Congress passed June the 7, 1832


State of North Carolina) Court of pleas and quarter Ses-
Haywood County) sions Septem Dec term 1832


On this 3 day of Januay AD 1833 personally appeared in open
court before the justices therein Samuel Monteith a
resident of the County of Haywood and State aforesaid aged
77.

As I was born in the year 1756 as I am informed as
there was no record of my age ever who being first duly
sworn according to law doth on his oath make the following
declaration in order to obtain the benefit of an act of
Congress passed June the 7th 1832.


I entered into the Services when I was between 18.and 20 
but the year I do not recollect nor the month as a 
Volunteer under the command of the following named officers 
I was living in Mecklinburg County NCarolina under Capt 
McClure. MacClure having no higher officer as he just 
raised a company of Volunteers and marched down to Cross 
Creek and below to Brunswick to keep the British from 
landing then until the man the experation of our three 
months tour for which I had volunteered I was then 
discharged by Capt McClure and cam home living out three 
month I got hom in the summer in the year 1778 or perhaps 
it might of been 1779. I agane entered the service about 
1789 as a drafted man under the command of Capt Osborn who 
march me from Mecklenburg to Charlestown marching threw 
Sharlot as I live about 14 miles above there by Monks 
Corner and took water about 10 or 11 miles above
Charlestown on Ashley river and sail down to Charlestown
and then remaine during the seige and then joined the army
of General Green and remained in Charlestown during the
hole seige but on the fall of Charlestown I was taken
prisoner and remained with them untill I was perrolled to
go hom on condition I do not lift armes until as charged my
perrolled was signed on the 20 day of May making another
three month tour and I came directly home the same day. I
went to Charlestown joined the Services again about a year
after geting hom from Charlestown Command by Col Smith
Maj Joseph Graham Capt Polk being drafted for a three month
term being a lite horseman and went from Mecklenburg
NCarolina march down threw the state, threw Anson
Montgomery and into Cumberlane Counties below Cross Creek
which is now called Fayetville and still went below
Willmington in New Hanover County an nothing more than sum
scrimaging with the tories who we routed several times and
come horn thru Randolph and one corner of Anson Counties
being out 3 month this timer the year I don't recollect but
the nuse came to us when we was below Willmington :that
Cornwallis was taken an soon after we recieve that
infermation we was discharged by Capt Polk I went out after
the Cherokee Indians sum time after peace was made with
grate Britain a three month tender as a packhorseman under
the command of general Rotherford Col McDowell and Capt
McDowell I went as to a river called Tuckaseigee, -
remained sum time untill the army returned from taking the
Volunteers and lost a horse worth for which never got
nothing and he was employed in the services of the army
never any discharge and I have no documentary evidence to
prove my service and I know of no body in this county that
I can prove it by. I was born in Pennsylvania, York Co.
He does hereby relinquish his every claim whatsoever to a
pension or annuity except the present and declare that my
name is not upon the pension Roll of the agency of any
state.

I Q When and in what year were you born?


A born in Pennsylvania York County in the year of 1756
I am informed.


2 Q Have you any record of your age and if so what is it?


A There never was a record of my age the reason I fix
the time of my birth is my father allways told me that I
was born the year after Gen Bradock died.


3 Q Where were you living when called into the service.
Where have you been since the revolution and where do you
now?


A I was living in Mecklinburg County NCarolina an lived
the during the war and move from there to Burke County then
to Haywood County where I now live.


4 Q How were you called into the service? Were you
drafted, did you volunteer or were you a substitute and if a
substitute for whom?


A The first term volunteered the second term I was 
drafted the third term and volunteered the 4 term. All 
my services making twelve months. 


5 Q State the names of Sum of the regular officers who
were with the troops when you served regiment as you
and the general circumstances of your services.


A I do not recollect any but Gen Green an Col Mabry. I
was ony short time with the army that I don't recollect
only my own was Capt the other officers not
recollect as the change so often that I can't & none of
the ones I recollect except Polk Maj Joseph Graham Col
Smith and Gen Rotherford.


6 Q Did you ever receive a discharge from service and if
so by whom was it given?


A I never had a regular written discharge that I now
recollect of. I am acquainted John B. Love John Buchanan
who can testify as to my and their believe of my
services of a soldier of the revolution.


Certificat


We John B. Love and John Buchanan residing in the
county of Haywood do hereby cerify that we are well
acquainted with Samuel Monteith who has subscribed and
sworn to the above declaration that we believe him to be 77
years of age that he is reputed and believed in the
neighborhood where he resides to have been a soldier of the
revolution and that we concur in the opinion Sworn to in
open court Jany 3d 1833.

And the said court do hereby declare thir opinion after the
investigation of the matter and after passing the the
war department that the above named applicant was a Soldier
of the revolution and served as he states and the court do
further certify that it appears to them that John B. Love
and John Buchanan who has signed the preceding certificate
are residents of the County of Haywood and are credible
persons and that the statement are entitled to credit.

the 7 June 1833 allowing pensions to the Revolutionary

The reason that I had not proved the certificate of a
clergyman is that there was none living in my
neighborhood. When I was at court to get my Declaration &
but few people had become acquainted with me for being old
and not Living long in that part of Haywood had not found
many acquaintances so when I made my Declaration there was
no Clergyman at Waynsville with home I had an acquaintance
& I was advised that the certificate of Mr. Love who was
the clerk of the session court would do as well as he was
named to an member of Congress to be a effectable man
& Mr. Buchanan being one of the justices of the court of
pleas & quarter sessions would give my papers full wait
this fact are being duly Sworn to before me Wm. Stanfull
one of the justices of the peace for said county this June
1833.

The undersigned a Justice of the peace for the
County. Samuel Monteith who being duly
sworn according to the law makes the following state
ment to the formality & the time of his ser
vice & the transmission of his and
made in oredr to obtain the benefits of an act
of congress passed the 7th June 18)2 granting pensi
ons to the soldiers of the revolutionary war
--by Mr.
and regularly threw the courte with all
formality only there was
certificate but two citizens
also certify to wit; John Buchanan Esq. and
John B. Love Esq. and tho the papers had once been
returned for amendment and to two reasons that was
not satisfactory was there was no
certificate & this was not explained that
there was from my neighborhood present when I
made my declaration as I live in a remote part
of the County and I then live in Haywood County
and being olde and inform I had not found an ac
quaintance that was anything like from the
time that I had moved to that county from Burk
County N.C. but I now live in Macon County N.C.
The other reason as well as I now recollect was the

so definite as to enable the department to
determine to what amount of pension I was entitled to.
This amendment made an other if required by
I have no recollection of any other but 
the mentioned for & the other was 
following in substance to wit: I was born in Pennsylvania, 
York County in the year AD 1756 and am 78 years of age. 

The month now as there was no record of my age and remain
there when a boy with my father to Mecklenburg County
N C and entered into the service of the United states

In the year 1777 as well as recollect about 21 years of 
age living in Mecklenburg County under the comma 
nd of Capt. Mac Clune as a volunteer for 3 months time 
an served out the time. I marched to Brunswick in
the British from landing & marched from there
I live in Mecklenburg to Brunswick and th~~~
was stationed until discharged by Capt. MacClune but
of discharge I now nothing about it now being olde
& infirm I cannot about these
things but I feel certain that I

drafted living in Mecklenburg N C & marched
to South Carolina & from there to Charlsetown
and was there at the siege under the command of
Capt. Aslun & when we got to Charles
town the British army had surrounded the town
& we took shipping about 11 miles above the town
I was under the command of Col. Mabary
was sent to about 9
miles from town river to keep the

British from coming into the town & I was taken
a prisoner at the fall of Charlestowm & I was par
roled by the British to go home on the 20 of May 1780

drafted & was a light horseman & a private in the year
1781 or the part of 1782 under the command of

age and I think it was in 1777 but it might of

will suffice without going thru the regular course
in Court again.


I do hereby relinquish all other claim to a pension
in any state or any agency whatsoever
making in all not lass than twelve months
if I am entitlrd to a pension for the J months
against the indians & if not 9 months as a pr
ivate in testimony where of I have hereunto set

MARGARET MONTEITH MAKES OATH

Jackson County)


On this the 19 day of Sept 1853 personally appeared
before me John B Allison Chairman of the Court of Please and
Quarter Sessions in and for Jackson County Mrs. Margaret
Monteith a resident of Jackson aged Eighty Six years who
being first duly sworn according to Law doth on her oath
make the following declaration in order to obtain the
benefit of the provisions made by the act of Congress passed
the Third day of February Eighteen hundred and fifty Three
that she is the widow of Samuel Monteith who was a Private
in the Revolutionary War and drew a Pension paid at the
North Carolina Agency at Fayetteville at the rate of Forty
Dollars per annum commencing on the 4th of March 1831. 


Recorded in Book E N b Page 49.


She further declares that she was married to the said
Samuel Monteith on the Thirteenth day of February Eighteen
hundred and Ten that her husband the aforesaid Samuel
Monteith died on the Thirteenth day of May Eighteen and
forty.

That she was married to him at the time above stated
she further swears that she was a widow at the pasage of the
act and is still a widow and that she has never before made
application for a pension.

I Thomas Monteith do swear that I was well acquainted
with Samuel Monteith and his wife Margaret and further swear
that I saw them married on the Thirteenth day of February
Eighteen hundred and Ten and I further swear that I lived a
neighbor to them up to his death which was about the year
Eighteen hundred and Forty and that Margaret Monteith Samuel
Monteiths widow is living at this time and further swear
that I have no Interest in her Pension claim this the 20th
day of Sept AD 1853 in open court.

of June 1844 by JohnWilson a JusticeofthePeaceforsaid 
County & State Submitted to the Court it doth appear his 
proceedings and the Court further certified that the 
Said Samuel Monteith died in Said County on the 13th day of 
May 1840 leaving Margaret Monteath his widow and here direct 
the clerk to indorse this approval on the papers.
