HEIRS IN DISPUTE OVER BOARD BILL

Demands of Melrose Woman For $709 Is Opposed.

Heirs of J. M. Schmocker, who died at Owen July 19, 1931, met at Judge O. W. Schoengarth’s office on Tuesday and put in a warm afternoon arguing against the claim for boar and care amounting to $709 which was filed by Tom Bruley of Melrose, husband of one of Mr. Schmocker’s daughters, Katarina.

The will provides that each of the seven children and one granddaughter are to receive an equal amount with the exception of Katarina who is to receive $200 less. Mrs. Bruley, testified that her father, who had lived with her much of the time since 1922 paid her $10 a month, but through her husband she is asking an additional $21 a mouth out of the estate, which she says is due for "board, washing, shaving, hair cuts and general care."

John Peterson of Owen attorney for the other heirs, brought out that Mrs. Bruley was not married to her present husband until 1927 and questioned the right of Mr. Bruley to file a claim dating back five years before he was married. Mr. Peterson also forced Mrs. Bruley to admit that the claim of $709 was not listed am9ong her assets when she went into bankruptcy in 1930. She excused that oversight by stating that the referee in bankruptcy had told her it was not necessary to list all the little items. The attorney asked her whether she thought $709 was a "little item."

Finally Mrs. Bruley offered to settle for $200 but the other heirs refused and decided to fight any payment on the claim.

Judge Schoengarth is withholding judgment pending further investigation.

Other heirs who were present were Mrs. Tillie Westfall of Cataract, John Schmocker, Owen, Mrs. Lent Schepke, Melrose.
