Copy of deed from Nehemiah Gale & wife to Asa Evans - dated Nov. 8, 1795 to be filed in the application of Elizabeth Evans for a pension............


This is a correct copy of an old deed sent here for inspection............


     Know all men By these Presents that I, NEHEMIAH GALE of Canaan County of Columbia State of New York  Do for and in the consideration of the sum of one Hundred and ten Pounds Lawful money of said State to me in hand paid by ASA EVANS of said town and county aforesd, the receipt whereof is hearby acknolidged and my self fully paid and satisfied  Do give grant bargain sell release convey and confirm unto the said ASA EVANS his heirs and assigns for ever all that piece or parcel of land lying and being in the town of Canaan County of Columbia Buted and Bounded as follows, beginning at a chestnutt Stand mark with stones about it then running on the road as the fence Now stands to WILLIAM CASEs corner to a stake and stones thence southwest to a stake & stones running westerly to a stake and stones then turning and running westerly to green stand mark with stones about it then turning North westerly and running to a walnut stand mark and stones about it then turning and running westerly to a white oak tree by the fence then turning and running southerly by WILLIAM CASE and THOMAS BENTLY as the fence now stands to a stand and stones about it and grape vines running on it then turning and running westerly as the Brook runs to T BENTLYs Northwest Corner then turning and running southerly as the fence now stands to a stake and stones then turning and running northerly to a white pine mark, and stones about it then turning and running westerly to a hard maple then turning and running northerly to the first mentioned Bounds reserving at the place called the mud hole going to the water priveledge of water on the mentioned line at the most convient place and do the least damage to Sd Evans, and to have a lane four rods wide to said Spring. ---- To have and to hold the above described premises with all priveledges....and appertaining unto him the said ASA EVENS his heirs and assigns and I do by these presents bind myself my heirs Executors or administrators to warrant and defend the same  free and clear from all persons claiming from by or under me in Testimony whereof I have hereunto sett my hand and seal this fifth day of November 1795.

Dear Sir.
  I herewith return the original deed made by Nehemiah Gale to Asa Evans, intended to be used as evidence in the case of Elizabeth Evans widow of Asa, and have the honor to inform you that the proof of marriage prior to 1800, will be admitted to be sufficient, and that a certificate of Pension will be issued upon the production of a certificate of court, showing the date of her husband's death.  Mr. Lemuel Jenkins is the Agent in the case.............

     NEHEMIAH GALE of the Town of New Lebanon in said county, being duly sworn Deposeth and saith, that he is seventy five years of age. - That he is well acquainted with ELIZABETH EVANS, widow of ASA EVANS, late of the town of New Lebanon in said county deceased - That the said ELIZABETH is a sister of this deponent. That he was present when she was married to the said ASA
That the marriage ceremony was performed by SAMUEL WHEELER, a Justice of the Peace, at the residence of NEHEMIAH GALE the father of the said ELIZABETH, in the town of Canaan is said county. - That according to this deponents knowledge, recollection & belief, the said marriage took place in the year Seventeen Hundred and Ninety four, or Ninety five, as this deponent distinctly recalled that the said ASA and ELIZABETH were married before the date of a certain deed from NEHEMIAH GALE to ASA EVANS, which deed is now in the possession of the said ELIZABETH EVANS, and bears the date the 8th day of November 1795, but he is unable to specify the time of said marriage.
More particularly - This deponent further saith that the said ASA EVANS died at his residence in said Town of New Lebanon in the Month of August 1851, leaving the said ELIZABETH his widow and that she has ever since remained a widow.
